Terms and Conditions

1.1.Own the Pitch is the trading name of Ideas Projects Limited. Ideas Projects Limited is registered in the UK under Companies House registration number 07566404, incorporated on 16.03.2011. The registered address is Innovation Centre York Science Park, Heslington, York, North Yorkshire, YO10 5DG. Accordingly, any reference to Own the Pitch, or any abbreviation of such, shall be construed as constituting a reference to Ideas Projects Limited.

1.2.Ideas Projects Limited, trading as Own The Pitch, is licensed and regulated in Great Britain by the Gambling Commission under account number 61121 to provide remote betting services. Only customers in Great Britain can access the Own the Pitch platform.

1.3.Own the Pitch’s concept was conceived by Ideas Projects Limited and the technical platform designed and maintained by Netsells Limited. Netsells Limited was granted a remote operating licence (account 61118) to manufacture, supply, install or adapt gambling software by the Gambling Commission in Great Britain. The Gambling Commission is responsible for the regulation of this software licence.

1.4.The contractual relationship between the registered user (also known as “account holder”, “you”, “your”, “customer”) and Own the Pitch is governed by this document (“Terms and Conditions”) and by the Laws of the United Kingdom, most particularly the Gambling Act 2005, the Consumer Rights Act 2015 and the Trading Regulations Act 2008.

1.5.Opening an account results in the acceptance of the Terms and Conditions outlined here, and each person registering for an account is bound by them through the existence of the relationship.

1.6.Own the Pitch reserve the right to alter or change these Terms and Conditions and the Rules of Play, at any time. Any change to Own the Pitch’s Terms and Conditions will be notified to the customer in writing in advance or at the earliest reasonable opportunity. If they are material changes the customer will be notified in advance (LC7.1 (3)). You as the registered user reserve the right to accept and proceed or decline and cease to use Own the Pitch’s services upon notification of such changes.

1.7.As we expand Own the Pitch’s offering, alternative language Terms and Conditions may be available if deemed necessary. The English language version shall prevail in the case of any conflict.

1.8.Should you require any clarification on the terms and conditions, please read this entire document carefully, and if you are still unsure reach out to support via email [email protected].

1.9.Ideas Projects Limited are satisfied that these Terms and Conditions are fair and transparent to account holders (LC7.1.1, SR4.1).

1.10.Own the Pitch is a unique betting offering in which a customer can buy multiple digital plots, up to a maximum of £2,000 of a sports pitch and when certain events occur within that digital plot can win prizes. Charitable donations are also made for certain in game events. The Rules of Play comprehensively explains the offering.

2.1.Own the Pitch takes complaints seriously. We want customers to enjoy their time on the platform, but if you are dissatisfied at the quality of our offering we have a Complaints Procedure for you to follow (available on the platform).

3.1.Account holders must be aged 18 years or older and based in Great Britain.

3.2.By accepting these Terms and Conditions you are verifying that you are a resident in Great Britain and you are over the age of 18. We reserve the right to request proof of age from you, or conduct further verification checks as to your identity, including age (LC7.1.1).

3.3.We are committed to the protection of children and vulnerable people from the harms related to gambling and all precautions are taken to ensure no one under-age is permitted to use our platform (SRCP3.2.11).

3.4.Only one account is allowed to be opened by a person and must be opened personally. Own the Pitch monitor accounts to identify any separate accounts held by the same person (SRCP3.9.1).

3.5.During the registration process you will be able to choose your login email, phone number and password. You can change this password at any time by going to your account. Login and account details should be kept confidential. Should you forget your password, you can reset it. Should you forget login details you must contact Own the Pitch to arrange entry, they may request additional identification for this.

3.6.All information submitted during the account registration process must be accurate and this is the responsibility of the account holder. This information includes, but it not limited to, your full name as per official identity documents, your current full residential address, your date of birth, and your personal email address/phone number. Should any information change, you agree to update your profile at the earliest opportunity, and at the latest prior to any further betting activity.

3.7.Own the Pitch reserves the right to examine and confirm your identity beyond the minimal requirement laid out by regulatory bodies (see clause 5.9 for more detail). Own the Pitch have made efforts to streamline such checks where possible, dealing with authorised and secure third parties, but very occasionally Own the Pitch may request that documentation proving your identity and residency is forwarded to its offices. Own the Pitch may suspend the account and all account functionality, including but not limited to, bet management and withdrawal of funds. Own the Pitch may close your account, should these demands not be met. In the event Own the Pitch are forced to act in these circumstances, any customer funds will be returned to the customer using the same payment method pursuant to clause 5, unless it is required to act in accordance with the Proceeds of Crime Act 2002 or the Terrorism Act 2000. This is further detailed in the Proceeds of Crime and Anti Money Laundering Policy.

3.8.Own the Pitch retains the right to make any queries regarding the source of any funds deposited with Own the Pitch. Should you fail to provide satisfactory responses to our queries, Own the Pitch may suspend the account and all account functionality, including, but not limited to, bet management and withdrawal of funds. Own the Pitch may also close the account. Own the Pitch may pass on such information as it deems necessary to the relevant authorities. In the event Own the Pitch are forced to act in these circumstances, any customer funds will be returned to the customer using the same payment method from pursuant to clause 5, unless it is required to act in accordance with the Proceeds of Crime Act 2002 or the Terrorism Act 2000. This is further detailed in the Proceeds of Crime and Anti Money Laundering Policy.

3.9.If an order is placed using your account, the order will be considered to have been made by you and therefore once accepted by us, it shall be considered valid unless it contravenes any other term.

3.12.You must not collude with other players or in any way that distorts normal game play. In accordance with Own the Pitch’s strict Anti-Money Laundering policies, we will monitor customer activity, irregular order matching, and take action and report suspicious behaviour to relevant authorities. This may include the suspension of accounts pending further investigation.

3.13.You are prohibited from transferring or acquiring accounts from or for other account holders.

3.14.In the event that you breach any provision in these terms and conditions, Own the Pitch reserve the right to close your account and any un-staked deposits will be returned to the customer pursuant to clause 5.

3.15.Own the Pitch may refuse to open an account or forcibly close an account without having to provide justification. Own the Pitch’s decision may stem from, but not be limited to, reasonable suspicion that any account is traced to the same address, IP address or computer. Winnings on any such account may also be frozen, existing contractual obligations will be honoured except in the cases where we suspect the accounts are connected with underage gambling, or involved in criminal acts, including money laundering.

3.16.All accounts are opened in and all transactions are made in GBP (Great British Pounds).

3.17.Own the Pitch is not a financial institution and there will be no interest paid on any funds held in your account. Furthermore, Own the Pitch ensure all customer funds are held in a separate bank account (LC4.1), however they are not protected in the event of insolvency (LC4.1).

3.18.It is your responsibility to keep track of winnings and report them to the appropriate authorities for any taxation purposes.

3.19.You may close your account with Own the Pitch at any time. You can do this by emailing us at [email protected]

3.20.Following termination, suspension or exclusion of your account, Own the Pitch will in the normal course of business, return any funds in your account and again following the settlement of any winnings. We reserve the right to withhold the funds in your account from you pending the result of any investigation. This includes, but is not limited to, where we suspect you acted in breach of these terms and/or where we have to withhold funds in your account by law to comply with a request from any governmental, regulatory or enforcement body.

3.21.Once an account is closed the purchase of any digital plot is deemed to have been surrendered.

3.22.Depending on the result of any such investigation we reserve the right to seize a portion or all of the funds in your account if we are satisfied that you have acted in breach of these terms or of other relevant agreements such as the Rules of Play. This does not apply to any un-staked deposit which remains a customer’s property and will be returned pursuant to clause 5.

5.1.Payments are made via debit card. The name on the card, or any other payment method must be identical to that of the account holder. If Own the Pitch identifies that payments have been made from a third-party, we reserve the right to immediately return the payment back to the source and void any winnings that have arisen from such a payment. Any charges levied by the banks and/or payment gateways will be deducted from the reversed amount.

5.2.When paying by debit card, your debit card account will be debited immediately upon completion of the transaction. Please be aware some debit card providers may charge a transaction fee. Own the Pitch promote a Responsible Gambling policy that outlines the maximum number of debit cards that can be used on an individual account in a twelve (12) month period. Credit Cards will not be permitted.

5.3.There are specific payment amounts for each digital plot at Own the Pitch you choose. The specific requirements can be found in the Rules of Play.

5.4.Any funds paid must be used to purchase a digital plot. Customers may not make deposits into their account. All payments made are for the immediate purpose of plot purchase.

5.5.Any suspicious activity on an account may lead to the account holder being reported to the relevant authorities and freezing of the accounts fund. Additionally, this could also lead to the closure of the account, confiscation of funds, and withholding of funds on behalf of the relevant authorities.

5.6.Own the Pitch requires settlement to use the same method as payment. All settlement payee details must match the account holder name on registration.

5.7.Own the Pitch will attempt to process settlements as soon as possible, in any event within two (2) working days from an award being confirmed.

5.8.A settlement can only be made after the completion of a game and once the information has been validated.

5.10.If further identification is required, this may include supplying a secondary document from the above list, or another form of identification such as a utility bill within the last 3 months. Before any further identification is required a member of the Own the Pitch team will cross references the ID provided with the selfie.

5.11.If within fourteen 14 days of a win being notified you have failed to provide additional details we require (i.e. you have exceeded the threshold detailed in 5.9), the request will be cancelled and funds returned to your account.

5.12.Own the Pitch aspire to lead the industry in terms of KYC and Anti-Money Laundering regulation. Own the Pitch reserve the right to require additional identification/verification checks prior to the thresholds being breached.

5.13.Own the Pitch is required by the Gambling Commission to inform its customers about what happens to funds that we hold on account for you, and the extent to which funds are protected in the event of insolvency. For further information on the Gambling Commission’s approach and requirements concerning the protection of customer funds, please take the time to read their policy found at https://www.gamblingcommission.gov.uk/guidance/customer-funds-segregation-disclosure-to-customers-and-reporting/the-customer-funds-insolvency-ratings-systemx. Own the Pitch holds customer funds separate from company funds. These funds are not protected in the event of insolvency. This meets the Gambling Commission’s requirements for the segregation of customer funds at the level: Not protected - Segregation of customer funds.

5.14.There is no way in which to transfer funds from one account to another. Only one account is permitted per person.

5.15.From time to time Own the Pitch may run promotions. Such promotions are subject to promotional terms which will be published at the same time and run alongside term 14 ‘Terms for Promotions’.

5.16.A statement of your account can be viewed when you are logged on and transactions can also be viewed. Customers will receive a digital Certificate of Ownership of their plot which can be viewed in their account.

6.2.The details of the charitable donation will be confirmed and made known before digital plots are available to be purchased for that specific club.

7.1.Own the Pitch have a Responsible Gambling Policy which we encourage all customers to read regularly. Any queries regarding the Responsible Gambling Policy should be sent to Own the Pitch, Innovation Centre, York Science Park, York, YO10 5DG.

7.2.For more information on responsible gambling, or for help or counselling, customers are directed to the GamCare website: https://www.gamcare.org.uk/, or similar sites. (SRCP3.5.3 (7)).

7.3.Own the Pitch are committed to operating responsibly and in accordance with the provisions of the Gambling Act 2005, in particular the licensing objectives.

7.4.Own the Pitch allows account holders to spend a maximum of £2,000 per person per season.

7.5.Own the Pitch only has a buy-in period of up to 16 weeks before the first match of play. Once this has closed, no further purchases can be placed for the entire season.

7.6.All account holders retain the right to self-exclude themselves from betting for a period between 6 months and 12 months. This period can be extended by a further 6 months, and again to a maximum of 5 years if required. No cooling off period is required to enter into a period of self-exclusion. During this time of self-exclusion it is not possible to reopen your account. Self-exclusions will persist for a minimum of 7 years unless account holders take steps to reactivate their account. Reactivation of a self-excluded account who’s terms of suspension has passed is subject to a one (1) day cooling off period. Reactivation of the account must be done over the phone or in person. You cannot reactivate your account online (OR3.5.4).

7.7.If an account holder has self-excluded, we will take all reasonable steps as soon as practicable to ensure marketing material is not being sent to that account holder (SRCP3.5.3 (2)).

7.8.Details of the account holder who has entered into a period of self-exclusion are retained in order to ensure the period of self-exclusion is fulfilled.

7.9.Own the Pitch also participate in the national multi-operator self-exclusion scheme (SRCP3.5.5).

7.10.Own the Pitch take responsible gambling very seriously. If you try and open duplicate accounts during a period of self-exclusion we will do our best to detect and close them. If, however, you are able to access our services, any losses incurred during the period prior to detection will not be refunded. Own the Pitch reserve the right to hold back winnings in such situations and need only return up to the deposit amount.

7.11.Any withheld winnings detailed in clause 3.15 will be donated to a responsible gambling charity of Own the Pitch’s choosing.

7.12.Own the Pitch have a 5 debit cards limit per twelve (12) month period usage policy. This is in accordance with our Responsible Gambling policy. Should Own the Pitch fail to prevent a sixth card being used to deposit due to a technical error, any bets placed or losses incurred using these funds will still stand.

8.1.Prior to purchasing a digital plot you should make yourself aware of the Rules of Play (available upon request). Due to the nature of Own the Pitch’s offering these betting rules may be different to other betting service providers.

8.2.The purchase of a digital plot can only be placed by a registered account holder and can only be placed remotely, via an internet connection, on an electronic communication device.

8.3.There is no credit facility at Own the Pitch. You must only place a bet if you have sufficient funds to do so.

8.4.An order is deemed to have been placed as soon as an acceptance of bet confirmation is received on your electronic device. You can see all bet confirmations in your account section of both the website and app.

8.5.By partaking in Own the Pitch’s offerings, you declare that at the time of bet placement, that you have no knowledge as to the outcome of an event. You are not allowed to place bets on markets that you have gained access to insider information. Own the Pitch monitor account activity and reserve the right to void bets or withhold funds (this does not include un-staked deposits which remain the property of the customer) where there is suspicion of violation of this rule. This may include measures to comply with other legal or regulatory bodies. We work closely with sporting bodies to maintain the integrity of the sport.

8.6.Orders placed after the outcome of an event should not be possible given the nature of the offering, but if they are placed they may be voided at Own the Pitch’s discretion.

8.7.Sometimes events will be stopped outside of Own the Pitch’s control. In such situations, Own the Pitch will recognise the rearranged fixture at a date set by the relevant governing body.

8.8.Should Own the Pitch choose to close an individual’s account, open bets that have been successful will not be voided and you will be paid out on winnings.

8.9.Mistakes are wholly the responsibility of the account holder. Errors do not influence the validity of the bet. Particular attention should be paid to the Rules of Play. It is your responsibility to ensure that you are betting on the specific digital plot you have chosen.

8.10.Own the Pitch reserve the right to void all bets where a market is displaying incorrect information or where an error has occurred. This includes, but is not limited to, erroneous third-party data provider feeds.

8.11.By placing an order, you acknowledge and confirm that you have read and understood the terms and conditions as well as Rules of Play and understand that you have placed a bet.

8.12.Winnings will be paid into your account once our third-party data provider has confirmed their first closure of the event. Errors amended after this point may not be able to be accounted for. Own the Pitch will aim to settle bets as soon as reasonably possible after the event is deemed over.

8.13.Own the Pitch operate a strict one account per person policy. Should Own the Pitch become aware that you have placed bets from different accounts, Own the Pitch reserve the right to void bets and take further action as deemed necessary.

8.14.Own the Pitch operate a strict £2,000 per season per person limit. Should Own the Pitch become aware that you have purchased over this limit, Own the Pitch reserve the right to void bets and take further action as deemed necessary.

8.15.Collusion is strictly prohibited. You are strictly prohibited from placing bets with the intention of transferring funds to another customer’s account. Own the Pitch monitor such trading activity and reserve the right to freeze accounts and pass on details to the appropriate bodies.

8.16.You agree to inform us of any potential error in Own the Pitch’s software at the earliest opportunity and should not seek to take advantage of any glitch or errors in the system.

9.1.Own the Pitch relies on official match event data reporting for both in-play (such as goals and free kicks) and post-play events. Own the Pitch accept no responsibility for errors, corrected or otherwise, and will settle markets according to the information at our disposal after the end of the match in question.

9.2.The reporting of information is subject to delay and the displayed information on either our website or app may not be accurate at the time. Only once the information has been validated at the end of a game can any withdrawals be made.

9.3.Stats Perform, the official match data provider to the Premier League, provide data for Own the Pitch. Under no circumstances can you copy, redirect or distribute the data provided on our website or app.

9.4.Whilst every care has been taken to select the most appropriate data sources, the manual nature of data collection means that the process itself is open to reporting errors and from time to time inaccurate relay of information. Own the Pitch accepts no responsibility for such mistakes and will aim to rectify and reflect mistakes as soon as we are notified by these third-party providers.

10.1.Own the Pitch and any logo will be trademarks of Ideas Projects Limited. Any unauthorised use of the brand and/or the logo of Own the Pitch could lead to legal prosecution by Own the Pitch.

10.2.All content found on ownthepitch.com, associated URLs, and Own the Pitch’s app, are owned by Own the Pitch. Unauthorised reproduction of this content could lead to legal prosecution.

10.3.The term Own the Pitch will be trademarked under UK trademark law.

11.1.Own the Pitch is only liable for gross negligence or deliberate actions carried out by its management, employees or various agents.

11.2.Own the Pitch is not responsible for the external services, pages or contents that may be linked from the Own the Pitch website.

11.3.Own the Pitch is not responsible for any of the consequences of loss of service triggered by major incidents, including but not limited to, terrorist activities, strikes, political crisis, war, natural catastrophe, downing of telecommunication networks, or any other matter beyond Own the Pitch’s control. Such triggers could lead to a complete or partial reduction in service offered on all electronic mediums supported by Own the Pitch. In such events Own the Pitch may at their sole discretion choose to cancel or suspend some or all of the services offered without incurring liability.

11.4.Own the Pitch is not to be held responsible for any consequences caused by the breakdown of any software or hardware either directly managed or outsourced. This includes breakdowns limiting or preventing access to some or all of its services.

11.5.In the event of a negligent act or mistake on Own the Pitch’s part the compensation available to an account holder would never be higher than your available funds or the sum of the bets involved in the act in question.

11.6.Should one or more of these terms be deemed void by a recognised Court of Justice, the remaining terms remain valid.

11.7.The Own the Pitch Terms and Conditions outlined in this document supersede and replace any previous written or verbal agreements between us.

11.8.Own the Pitch accepts no responsibility to you or a third party arising directly or indirectly from a mistake, misprint, malfunction of software provided by Own the Pitch. The denial of responsibility also applies to mistake, misprint, malfunction of software on any of its affiliates and/or partners.

12.1.Your privacy is extremely important to Own the Pitch.

12.2.You agree to receiving marketing communication from Own the Pitch and its club affiliates. Methods and frequency of communication can be altered in your account settings, as well as app notification settings on your phone/tablet.

12.3.All personal information that you share with Own the Pitch will be kept securely and may be transferred to relevant authorities on request. We reserve the right to supply your details to authorised credit reference agencies or identity verification companies.

12.4.Anonymised betting information may be shared with third party providers, but we shall not share your personal identifiable details.

12.5.Own the Pitch will use personal information and other information collected on you to provide customer support and undertake security and identity verification checks.

12.6.Own the Pitch will retain all information for the time set out by applicable legislation. Regulators may also direct time requirements. You are able to contact Own the Pitch and ask them to erase any or all of your information, but the request will only be answered if it is compliant with applicable law or regulator.

12.7.Own the Pitch use certain browser cookies to improve the customer experience. These cookies aim to improve your experience and will not interfere with your privacy.

12.8.We reserve the right to share your personal information in the occurrence of a company event such as takeover, merger or other disposition.

13.1.From time to time technical difficulties may be encountered resulting in unscheduled downtime to the website. This may leave you unable to manage open bets. You can contact customer support to clarify your position.

13.2.Once an order has been placed on the platform, there is no guarantee that the account holder can cancel or amend an order.

13.3.Your order is deemed to be placed as soon as it has been processed by Own the Pitch’s servers. We aim to provide account holders with an acceptance message quickly, however in exceptional circumstances there may be a delay or not be one. In such a situation, the account holder should go to their account page for clarification, and if not there contact customer support.

13.4.Orders received on our servers are deemed final, even if there is a break in communication notifying you. Equally, orders that are not received by our servers will not register as a bet, and the deposit will not be taken from your account balance. If you are unsure of your position do not make more bets, contact support immediately.

14.1.The following terms apply to all promotions. There will be additional terms per specific promotion that will be accompany the promotion and supplement this section.

14.2.Promotion participants must be over 18 years old. Underage bets will be voided and any stakes will be returned to the customer using the same payment method pursuant to clause 5.

14.3.Promotions are made available once per account holder. Own the Pitch reserves the right to withhold any promotional benefits it suspects may have arisen from linked accounts.

14.4.Promotions are a privilege and Own the Pitch’s decision on promotional matters are final.

14.5.Email, SMS and push notification promotions will only be available to customers who directly receive them from Own the Pitch. Promotions are not necessarily shareable or forward-able.

14.6.Promotions are non-transferable and not necessarily sharable with other Own the Pitch customers.

14.7.By entering a promotion, you agree to these terms, as well as the promotion specific terms.
